Terms of Service

1. Who we are

NovaMerch ("we", "us") is operated by Ranch Technologies. We give creators an online store at novamerch.net/their-name, take payment from fans, and arrange for each order to be printed and shipped or delivered as a download. You can reach us at hello@novamerch.net.

2. Using NovaMerch

• You must be at least 18 to open a creator store. If you are under 18, you may buy only with a parent or guardian's permission.
• Give accurate information, keep access to your email account secure (we sign you in with a link sent to your email), and tell us if you think someone else has used your account.
• Don't misuse the site: no attempts to break in, overload it, scrape it, or get around its limits, and no fraud.

3. Buying from a store

Orders and payment

• Each store belongs to a creator, and NovaMerch sells and processes orders on the creator's behalf. Payment is taken securely by Stripe; we never see or store your full card number.
• Prices are in US dollars. Shipping is shown before you pay. Your card issuer may add fees for purchases made in another currency.
• An order is accepted when payment succeeds and you see the order confirmation page. We may cancel and fully refund an order if an item is out of stock, priced in error, or the order looks fraudulent.

Delivery

• Printed items are made to order by our print partner (Printful) and usually ship within 2–7 business days, plus transit time.
• Creator-shipped items (for example signed or handmade items) are packed and shipped by the creator, who agrees to ship within 5 business days of the order.
• We currently ship to the countries offered at checkout. Import duties or taxes charged by your country, if any, are your responsibility.
• Please make sure your shipping address is correct; we can't always change it once an order is in production.

Digital downloads

• After payment you get a private download link (also findable on the Find your downloads page with your order number and email). Each purchase can be downloaded up to 10 times.
• A download gives you a personal, non-exclusive license to use the file for your own non-commercial purposes, for example as your phone's ringtone. You may not resell, share, upload, or redistribute the file, or use it in your own products, unless the creator's product description says otherwise.

Cancellations, returns and refunds are covered by our Refund Policy.

4. Selling as a creator

Your store and your content

• You keep ownership of the designs, photos, files, text, and other content you upload ("your content").
• You give Ranch Technologies a worldwide, non-exclusive, royalty-free license to host, display, copy, print, and deliver your content as needed to run your store, fulfill orders, and show your store and products in NovaMerch marketing. This license ends when you delete the content or your store, except for orders already placed and copies kept as required by law or for our records.
• You promise that you own or have permission to use everything you upload, and that it does not infringe anyone's copyright, trademark, privacy, or publicity rights. Don't use other people's logos, characters, music, or photos unless you have the right to.

What you can't sell

No content that is illegal, sexually explicit, hateful, harassing, violent, or misleading; no counterfeit or infringing goods; and no items that are dangerous or that you are not legally allowed to sell. We may remove products or stores that break these rules.

Prices, fees, and earnings

• You set your prices, above a minimum that covers production cost.
• For each sale, your earnings are the sale price minus the production cost (the print partner's cost, or the item cost you enter for items you ship yourself), minus the NovaMerch fee of 15% of that profit, unless we agree a different rate with you in writing. Shipping charged to the fan covers delivery. Your Studio shows exactly what you earn before you publish.
• Earnings are paid out to the payout account you connect, on the schedule shown in your Studio. Items that are refunded or cancelled are removed from your earnings. If a refund or chargeback happens after you were paid, we may deduct it from future payouts.
• You are responsible for any taxes on your earnings. We may ask for tax information required by law.

Items you ship yourself

• List accurate descriptions, photos, and stock levels, and ship within 5 business days using a tracked service (you can buy labels in your Studio).
• You are responsible for the item's condition and for handling returns for items you ship, in line with our Refund Policy. If you can't ship an order, cancel and refund it from your Studio right away.

5. Copyright complaints

If you believe something on NovaMerch infringes your copyright or trademark, email hello@novamerch.net with: your contact details; a description of the work; the link to the material; a statement that you believe in good faith the use is not authorized; and a statement, under penalty of perjury, that your notice is accurate and you are the owner or authorized to act for the owner, with your physical or electronic signature. We will review it, may remove the material, and may close the stores of repeat infringers.

6. Suspension and closing your account

You can close your store at any time by contacting us. We may suspend or close a store or account that breaks these terms, puts fans or other creators at risk, or that we are legally required to act on. Orders already placed will be fulfilled or refunded, and any earnings you are owed, less refunds and fees, will be paid out unless they relate to fraud or a breach of these terms.

7. Disclaimers

We work hard to keep NovaMerch running and accurate, but the site is provided "as is" and "as available". To the extent the law allows, we make no warranties beyond those stated in these terms and our Refund Policy. Creators are responsible for their own content and for items they ship themselves. Nothing in these terms limits rights you have under consumer protection laws that can't be waived.

8. Limitation of liability

To the extent the law allows, Ranch Technologies is not liable for indirect, incidental, or consequential losses, such as lost profits or data, and our total liability for any claim is limited to the greater of the amount you paid us, or the fees we earned from your sales, in the 6 months before the claim, or US$100. This does not limit liability that can't be limited by law.

9. Indemnity

If you are a creator and a claim is brought against us because of your content, the items you ship, or your breach of these terms, you agree to cover our reasonable costs and losses from that claim.

10. Changes to these terms

We may update these terms as NovaMerch grows. We'll change the date at the top, and for important changes we'll let creators know by email before they take effect. Using the site after a change means you accept the updated terms.

11. Disputes and governing law

Please contact us first; most problems can be solved quickly by email. These terms are governed by the laws of the State of Florida and the federal laws of the United States, without regard to conflict-of-law rules. Any court case about these terms will be brought in the state or federal courts located in Florida, except that you may bring a claim in your local small claims court if it qualifies. If you live outside the US, you also keep any protections the consumer laws of your country give you.
